Property Information:
TRACT 1 consists of 116.6+/- acres with approximately 115 acres being tillable. The property is located on CR 500S just east of Hwy 58. This tract has a center pivot irrigation system w/ a corner attachment and irrigation well. This is a highly productive tract suitable for growing specialty crops including watermelons & vegetables as well as conventional crops. This tract is accessible with a county road along the south property line.

TRACT 2 consists of 207+/- acres with approximately 176 acres being tillable. This tract is located on CR 500S just east of Tract 1 & also fronts CR 550W on the east & CR 400S on the north. Special Conditions: BIDDERS SEMINAR: A bidders seminar, designed to explain the Freedom Tract auction method, will be held 30 minutes prior to the auction. MINERAL RIGHTS: Seller believes they own all mineral rights and will convey everything they own to the purchaser. AUCTION PROCEDURE: The property will be sold using the “Freedom Tract” auction program. The property will be offered in tracts, combinations of tracts, or as an entirety, as the bidders desire. The offering is made in such a manner that all bids remain open until the auctioneer declares the bidding closed. The manner in which the bids total the greatest amount of money, configured as desired by Seller, resulting in the highest price for the Property, will be declared the winning bids. A 6% buyer’s premium will be added to the high bid(s) to determine the contract selling price. TERMS AND CONDITIONS: The terms and conditions of this auction shall be governed by the Contract for Sale of Real Estate. EARNEST MONEY DEPOSIT: An earnest money deposit equal to 10% of the contract purchase price is payable at the signing of the Purchase Agreement. BID APPROVAL: The final bid is subject to the approval of the Seller to sell the real estate. TITLE EVIDENCE: Seller shall pay any expense of title search fees, which shall be paid to the Title Companies, covering the Property, and Purchaser shall pay the base premium charged by the Title Companies for an owner’s title insurance policy covering the Property and issued by a local title company. Buyer shall pay the premiums charged for any endorsements to the Owner’s Title Insurance covering the Property and any lender’s mortgage title insurance policy or loan policy covering the Property. POSSESSION: Possession of the Property will be at closing on all tracts except Tract 6 and an area of Tract 1 around the farm headquarters to accommodate an auction of the farm equipment scheduled for January 2008. SURVEY: Seller will provide a current survey, only if a tract division has created a need for a new legal description. The type of survey performed shall be at the Seller’s option and sufficient for providing deletion of survey exceptions in the title insurance policy. REAL ESTATE TAXES: Purchaser(s) shall assume the real estate taxes due and payable in May 2008 and all subsequent real estate taxes. CLOSING: Closing under all Purchase Agreements shall be on a date no later than 30 days after delivery of insurable title to purchaser or his agent. PREREGISTRATION AND PRIORITY SEATING: Priority seating will be available to bidders that are pre-registered for the auction. The seats will be reserved and held until 15 minutes prior auction time.
