REAL ESTATE ROUNDUP: TITLE IN REAL ESTATE
Part 1: TITLE FAQ (Frequently Asked Questions)
Q: What is title in real estate?
A: Title in real estate refers to the right of ownership of real property, as
represented by the "Bundle of Legal Rights". It also refers to evidence of that
ownership by a deed. Another way to think about title is as the interest one
holds in real property.
Q: What is the "Bundle of Legal Rights"?
A: These are rights that come with ownership of real estate; a purchaser of
real estate actually buys these rights from the seller along with the land. The
rights define and describe the ownership of real property. They include the
rights of possession, control (within legal boundaries), enjoyment (use),
exclusion (prevent others from using), and disposition (transfer or disposal).
The term "bundle of rights", like many of our legal concepts, originates from
old English law, when the seller would give the buyer a handful of earth or a
bundle of sticks from the property. This was meant to represent that the buyer
now owned the land from whence the earth or sticks came.
Q: Is the title to my property a physical document that proves ownership of
real estate?
A: No. Title is the set of circumstances that would allow one to recover or
retain ownership of real estate if that ownership was challenged in court.
These circumstances include physical possession of the real estate; they also
include the existence of a deed, which should always be legally recorded. A
deed is a written instrument that provides evidence of ownership (title) of
real property. A deed is also the document used to transfer title to real
property.
Q: What are the differences between title, estate, and tenancy?
A: Title is ownership of or interest in real property. Estate is commonly
described as referring to the degree, quantity, nature, or extent of that
interest. Tenancy refers to the form of real estate ownership or the way the
interest is held.
It should be pointed out that not all interests in real estate constitute
estates. The interest must be possessory in order to be considered an estate.
This means that the interest must allow one to possess the real property,
either now or in the future. Interest in real property that allows use but not
possession, such as an easement, is not considered to be an estate.
Q: Are there different types of title?
A: Yes. These include allodial, feudal, and the fee simple estate.
We will continue this series in the next few issues, discussing the different
types of title, estates, and tenancies. Also included will be a section on
deeds and transfer of title.

Using Photos To Sell Your Real Estate On EagleStar.Net
We have observed that the properties that sell the fastest on Eaglestar.net are
the ones that take advantage of our photograph and image feature and make the
most effective use of photographs and other images as part of the listing.
Attractive photographs that capture scenic views on or from the property, show
interior or exterior views of homes or other structures, or highlight specific
features are highly recommended. Other types of images that may be helpful to
include are aerial photographs, assessors' maps, or location maps.
Eaglestar.net allows you to add up to 10 images with your paid property
listing. Below you will find tips on using images in your Eaglestar.net
listing, including information on how to optimize your picture files for
internet viewing. Following these instructions will help to ensure that your
property's listing web page will receive greater amounts of internet traffic.
The goal is to provide clear, quality images that can be quickly viewed by all
web visitors, even those with slow computers or internet connections.
Picture Size
The optimum pixel size for our site (and most other sites on the web) is 640
pixels on the longest dimension (height or width) of the image, although
anywhere between 500 and 800 pixels will work. Most photo editing programs have
a resize function that will allow you to reduce the number of pixels in the
picture file. When resizing, make sure that the aspect ratio is maintained
(usually automatic or listed as an option in the resize window). This will
maintain the original width-to-height ratio of the photo or picture file. For
pictures with a low pixel count, we do not recommend using the resize function
to increase the number of pixels, as this will cause distortion and render the
picture unusable. If your picture files do have low pixel counts (below 150 on
the longest dimension of the picture), you may want to consider obtaining
higher-resolution pictures, since low-pixel images will appear blurry on the
internet.
File Type
Most photo editing programs allow you to change files from one type to another.
Ideally, your photos or other images should be the .jpg (JPEG) file type,
although the .gif (GIF) file type will work as well. Your photo editng program
should have file conversion as an option. If it does not, try resaving the file
as a JPEG (.jpg) or a GIF (.gif), using the program's "File>Save As" function.
Resolution
Most photo editing programs also have a feature for changing the resolution of
the image file. Resolution is the fineness or coarseness of an image as it was
digitized, measured as dots-per-inch (DPI). The recommended resolution for
display on the internet is between 72-100 (DPI). A resolution of less than 72
DPI makes the image fuzzy or blurry (too coarse). A resolution of greater than
200 DPI makes picture files too large for practical use on a web page. The
files will load slowly into visitors' web browsers, and some visitors with slow
computers or internet connections may not be able to view them at all.
Why Pictures?
Visitors to Eaglestar.net want to see pictures of available properties. The
language in a listing might achieve a concise yet eloquent description of the
property, but this description must be filtered through the reader's
perceptions or interpretations. Humans are visual creatures and respond to
visual cues and stimuli. Combining written descriptions with images that show
some of the property's highlights and features takes advantage of this fact.
The effectiveness of images in advertising is well-known, well-studied, and has
a proven track record.
Consider this: Over the years, we at Eaglestar.net have directly observed that
a group of diverse pictures of an available property has often motivated a
prospective buyer to spend the money on an airline ticket or a tank of gas to
come out to look at the property. We allow up to 10 pictures on each property
ad and urge advertisers to use all picture spots available.
Picture Subject
Spring, summer and fall pictures are best; in most cases, any image is better
than none. Keep in mind that images on Eaglestar.net can always be replaced
with newer and better ones. When selecting photograph subjects, the following
work extremely well:
Scenic views
Buildings and improvements
Water features (lakes, ponds, rivers, creeks, springs, etc.)
Exterior and interior views of homes or other buildings
Wildlife
Anything you think may be of interest to prospective property buyers
Digital Cameras and Other Sources
Images from digital cameras are preferred to scanned images. Pictures from fax
machines and brochures often do not turn out well. The digital camera is
perhaps the best source of good quality pictures for internet display. The
newer, higher-megapixel cameras create beautiful photographs. At the same time,
they tend to create huge digital files that are occasionally difficult to send
through the internet. Please make sure that before you submit your pictures,
they are ready for posting (correct size, resolution, etc.). If you are unable
to edit your picture sizes and resolution then you may send those pictures to
us by e-mail at info@eaglestar.net. Send only one or two at a time in separate
e-mails, and we will resize and post them for you on your ad.
