REAL ESTATE ROUNDUP: A Short Guide to Zoning
Zoning is the regulation of land use and development within certain geographic
areas, commonly known as zones or zoning districts. Occasionally, zoning
regulations can differ by individual property, rather than by zoning district.
Authority to make and enforce these laws usually lies with municipal
governments; hence regulations exist mainly in the form of city or county
ordinances. State legislatures grant zoning powers to local governments
through legislation called "enabling acts".
Zoning restricts property rights and land use, including specific allowable
activities, lot size, types of structures permitted, building heights and
styles, setbacks, density, and protection of natural resources. The most
common zoning categories or classifications are residential, industrial,
agricultural, commercial, and recreational. Special or conditional zoning
allows land uses and activities not covered under other zoning classifications.
Examples include detention centers and prisons, government buildings, sewer
treatment facilities, cemeteries, churches, and landfills. Special zoning is
often allowed through special-use permits, also known as conditional-use
permits.
Generally, the objectives of zoning ordinances are to promote and protect the
health, welfare, and morals of the public and to ensure that development
proceeds according to a community's master plan. Zoning regulations are often
quite flexible in order to achieve these desired outcomes. For example,
different areas of a subdivision, neighborhood, or zoning district might be
subject to different types of zoning so as to provide for a variety of housing
types, as well as innovative residential and non-residential development. Some
examples of these zoning types include spot or strip zoning, which allow a
permanent change in or exemption from existing zoning regulations for
individual (spot) or adjacent (strip) parcels of property.
There are two main avenues of recourse a property owner can take if zoning
regulations prevent a reasonable land use. If the intended use is allowed as a
conditional use within a certain zone, the owner may apply for a
conditional-use permit. If the intended land use is prohibited within that
zoning district, the owner must petition for a zoning variance, which bypasses
some or all of the existing zoning regulations for a specific parcel of
property. Variances and conditional-use permits are usually issued only after
a public hearing is held on the matter. After all, adjacent landowners
purchased their property under certain zoning conditions and should be allowed
to comment on any proposed changes.
Zoning regulations and the agencies that administer them differ by location. To

find zoning information online.
